قانون العمل يلزم بتعويض العامل حال إنهاء خدمته لأسباب غير مشروعة
يحدد مشروع قانون العمل الجديد الذي قدمته الحكومة إلى مجلس النواب، الآثار المترتبة على قيام صاحب العمل في القطاع الخاص بإنهاء عقد العامل غير محدد المدة لسبب غير مشروع، حيث يلتزم صاحب العمل بمنح العامل تعويضا في هذه الحالة.
وينص مشروع قانون العمل على أنه إذا أنهى صاحب العمل العقد غير محدد المدة لسبب غير مشروع، يحق للعامل تعويض الضرر الذي لحقه بسبب هذا الإنهاء بمقدار أجر شهرين عن كل سنة خدمة، مع عدم الإخلال بحق العامل في المطالبة بباقي حقوقه. المقررة قانونا.
وبحسب المشروع فإن الأسباب التالية لا تعتبر مبررات مشروعة وكافية لإنهاء عقد العمل غير محدد المدة:
1- انتساب العامل إلى تنظيم نقابي، أو مشاركته في النشاط النقابي في نطاق هذا القانون.
2- يمارس صفة مفوض العمل، أو سبق له أن مارس هذه الصفة، أو يسعى لذلك.
3- تقديم شكوى أو رفع دعوى على صاحب العمل أو المشاركة في ذلك تظلماً من مخالفته للقوانين أو الأنظمة أو عقود العمل.
4- التوقيع على حجز حقوق العامل تحت رقابة صاحب العمل.
5- يستعمل العامل حقه في الإجازات الممنوحة له وفقاً لأحكام هذا القانون.
6- اللون أو الجنس أو الحالة الاجتماعية أو المسؤوليات العائلية أو الحمل أو الدين أو الرأي السياسي.
