تمت صياغة مشروع قانون التصالح في بعض مخالفات البناء، والذي أقره مجلس النواب نهائياً، لتسهيل تقدم المواطنين وتشجيعهم على التقدم للتصالح على المخالفات القائمة، كحل لمشكلة مخالفات تركيب الأعمدة أو الجدران أو الأعمدة والجدران أو الأعمدة والأسقف التي تقبل طلبات التصالح عليها في ضوء أحكام القانون. رقم 17 لسنة 2019 بالسماح بتعديل القرار بدون رسوم بإضافة تصريح استكمال أعمال الطابق ضمن نفس المساحة المتفق عليها وبنفس الارتفاع.
وفي هذا الصدد، جاءت المادة الثالثة من مواد صدور مشروع القانون تجيز المخالفات التي لم يكن فيها إلا أعمدة أو جدران، أو أعمدة وجدران، أو أعمدة وأسقف، والتي تم قبول التصالح فيها وتقنين الوضع في ضوءها لأحكام القانون رقم (17) لسنة 2019 المشار إليه، المعدل. وأضاف القرار، دون أي رسوم، تصريحاً باستكمال أعمال الأرضيات ضمن نفس السطح المتفق عليه وعلى نفس الارتفاع، وذلك وفقاً للضوابط التي تحددها اللائحة التنفيذية للقانون المرافق.
ويهدف مشروع قانون التصالح في بعض مخالفات البناء إلى تقديم العديد من التسهيلات للمواطنين أهمها إمكانية التصالح على بعض المخالفات التي يمنع التصالح عليها بالضوابط (الخطوط التنظيمية – المباني المتميزة – الارتفاعات الزائدة وقيود الطيران المدني) – حقوق الارتفاق) والسماح بالتصالح خارج الحيز العمراني (السكني – غير السكني). ).
وأتاح لمجلس الوزراء تجاوز بعض الانتهاكات التي يمنع التصالح عليها والتي يستحيل أو يصعب إزالتها. كما سمح بتشكيل لجان من داخل الهيئة الإدارية وخارجها. وأجاز لرئيس الوزراء في بعض الأحيان إسناد تشكيل وعمل اللجان إلى أي طرف آخر، واشترط دفع مبلغ 25% لتأكيد جدية المصالحة.
