قانون البنك المركزى يفرض 6 محظورات على البنوك.. تعرف عليها
تضمن قانون البنك المركزي والجهاز المصرفي الصادر بالقانون رقم 194 لسنة 2020 عدداً من المحظورات على البنوك، حيث نص على أنه يحظر على البنك ما يلي:
1- إصدار الكمبيالات المستحقة الدفع لحاملها عند الطلب.
2 – قبول الأسهم المكونة لرأسمال البنك ضمانا للتمويل أو التعامل بأسهمه مع مراعاة أحكام قانون الشركات المساهمة وشركات التوصية بالأسهم والشركات ذات المسؤولية المحدودة وشركات الشخص الواحد المصدرة بموجب القانون رقم 159 لسنة 1981 في هذا الشأن، ما لم تؤول إلى البنك قيامه بسداد دين مستحق للغير، على أن يقوم البنك ببيعه خلال ستة أشهر من تاريخ نقل الملكية.
3- أن تزيد القيمة الاسمية للأسهم أو الحصص التي يملكها البنك، في غير أغراض التداول، عن مقدار القاعدة الرأسمالية للبنك.
4- الدخول كشريك متضامن في شركات التضامن والتوصية بالأسهم.
5- التعامل في المنقولات أو العقارات بالشراء أو البيع أو المقايضة، باستثناء:
– العقار المخصص لإدارة أعمال البنك أو لتقديم الخدمات الاجتماعية أو الصحية لموظفيه.
– المنقولات أو العقارات التي تنتقل إلى البنك وفاءً لدين مستحق له على الغير، على أن يتصرف البنك فيها خلال سنة من تاريخ التحويل للمنقول وخمس سنوات للعقار. . ويجوز لمجلس الإدارة تمديد المدة إذا اقتضت الظروف ذلك، وله إعفاء بعض البنوك من هذا الحظر حسب طبيعة التحويل. نشاطها.
6- منح تسهيلات ائتمانية لشراء أسهمه في رأس المال.
