تفاصيل قرار قضائى بإلغاء فرض رسم على إطلاع "جدول الجنح" بالمنصورة.. برلمانى
ورصد موقع “برلماني” المتخصص بالشأن التشريعي والبرلماني، في تقريره تحت عنوان: “ما ضاع حق ومن خلفه مطالب”، استعرض فيه قرارا قضائيا بفرض رسم مراجعة “جدول جنح” بالمنصورة والمحامون يتجهون للاستئناف على القرار أمام مجلس الدولة والمحامي نيابة جنوب المنصورة تلغي القرار ردا على المحامين وقد ثبتت كل هذه الأحداث في الدعوى، وأدرجت صورة من قرار إلغاء رسم مراجعة الجنح في نيابة المنصورة. وتم حجز القضية للحكم لجلسة 18 يناير 2024.
وترجع الأسباب التي بنيت عليها الدعوى إلى أن القرار بتحصيل رسم مراجعة في الجنح لدى نيابة المنصورة جاء مخالفة صريحة لنص المادة 37 من القانون رقم 90 لسنة 1944 في شأن الرسوم القضائية ورسوم التوثيق في الدعاوى المدنية. المسائل المعدلة بالقانون رقم 126 لسنة 2009 بتعديل بعض أحكام قانون الرسوم القضائية في المواد. المدنية، والجنائية، وأمام مجلس الدولة، والتي نصت صراحة على أنه: “لا يُفرض أي رسم على إبلاغ ذوي الشأن بالدعاوى القائمة”.
وجاء في “الدعوى”: بما أن هذه الرسوم هي رسوم بلا قانون، بل في مخالفة واضحة لنص قانوني واضح وصريح، فقد جعلت هذه الرسوم إجبارية بحيث لا يمكن الاطلاع على ما تم في الدعاوى بالجدول المخصصة لذلك إلا بعد سداد هذه الرسوم التي فرضت لنظر الدعاوى في لائحة جنح القسم الأول المنصورة فقط، دون فرض أي رسوم على نظر جنح القسم الثاني المنصورة، وكذلك لائحة جنح قسم المنصورة مركز المنصورة، وبما أنه من المقرر قانوناً أن الرسوم القضائية تعتبر مساهمة من المتقاضين لدى الدولة في تحمل نفقات المنشأة القضائية، والسبيل لذلك هو فرض الرسوم القضائية استناداً إلى الأداة التشريعية المقررة دستورياً. .
