"لو هتشتري سيارة مستعملة".. اعرف حقك كمستهلك بالقانون
حدد القانون رقم 181 لسنة 2018 بإصدار قانون حماية المستهلك مجموعة من الحقوق للمستهلك إذا قام بشراء سيارة مستعملة، ونصت المادة 35 من القانون: “في حالة بيع السلع المستعملة يلتزم المورد لتوضيح للمستهلك حالة السلعة وأي عيوب بها، وذلك على النحو التالي: كما هو مبين في اللائحة التنفيذية لهذا القانون، في حالة بيع المركبات المستعملة، يلتزم المورد بتزويد المستهلك بتقرير فني عن السلعة. حالة المركبة وعيوبها الصادرة من مركز الخدمة المرخص له بمزاولة هذا النشاط ما لم يتم الاتفاق على خلاف ذلك.
ويكون المورد ومركز الخدمة الذي أصدر التقرير مسؤولين بالتضامن إذا ثبت أن أي منهما أخفى عمدا بيانات جوهرية تؤثر على سعر الشراء أو إتمام عملية البيع، أو إذا كان تقرير التفتيش غير متضمن تلك البيانات مستحقا للإهمال الجسيم من جانب أي منهم.
ونصت المادة 34 من نفس القانون: يلتزم المورد بتوفير مراكز الخدمة والصيانة والإصلاح وقطع الغيار الأصلية أو المعتمدة للسلع المستوردة أو المنتجة محلياً. ويلتزم المورد بإخطار الهيئة بمراكز الخدمة والصيانة المعتمدة وبأي تغيير يطرأ عليها على النحو الذي تحدده اللائحة التنفيذية لهذا القانون.
ويحدد مجلس إدارة الهيئة، بقرار يصدر بعد أخذ رأي جمعيات الأعمال ذات العلاقة، مدة تنفيذ الالتزام الوارد في الفقرة الأولى من هذه المادة، والسلع التي تعفى منه بسبب طبيعتها أو بسببها. إلى الجمارك التجارية.
