عدم دستورية حرمان الموظف المحبوس احتياطيًا من نصف أجره عن مدة حبسه
قضت المحكمة الدستورية العليا، في جلستها التي عقدتها اليوم السبت برئاسة المستشار بولس فهمي اسكندر – رئيس المحكمة، بعدم دستورية نص الفقرة الأولى من المادة 64 من قانون الخدمة المدنية الصادر بالقانون رقم 81 لسنة 2016. حيث تضمنت حرمان الموظف الاحتياطي من نصف أجره عن مدة حبسه. وفي نطاق تطبيقه على حالات انتفاء المسؤولية الجنائية بحكم نهائي أو قرار قضائي غير قابل للاستئناف.
وقال المستشار محمود محمد غنيم، نائب رئيس المحكمة الدستورية العليا ورئيس المكتب الفني، إن المحكمة بنت حكمها على أساس أن القانون ينص على تنظيم الحالات التي يستحق فيها التعويض عن مدة الحبس الاحتياطي أو عن مدة الحبس الاحتياطي. تنفيذ الجملة. وصدر حكم نهائي بإلغاء العقوبة المنفذة بموجبه، والتي استحدثها نص المادة (54) من دستور 2014، أي أن التزام الدولة بالتعويض في تلك الحالات أصبح أمراً مقضياً به. وينتظر التشريع صدور تشريع ينظم حالات التعويض عن الحبس الاحتياطي التي تقوم بها السلطة القضائية، في الحالات التي ينفي فيها المسؤولية الجنائية عن المحبوس احتياطيا، وليس هذا هو الحال بالنسبة لمن حرموا بنص تشريعي. نصف أجره عن مدة سجنه، حيث يصبح استرداد العامل نصف أجره المحروم تعويضاً عن الخسارة التي لحقت به، ويلتزم صاحب العمل بالوفاء بالالتزام الدستوري المنصوص عليه في المادة (54) المشار إليها، بينما أما استرداد باقي عناصر التعويض – في الأحوال المستحقة – فهو مرهون بصدور تشريع يحدده النص الدستوري نفسه.
وأضافت المحكمة أن النص المشار إليه يتنافى مع مبدأ البراءة، وينتهك حق الملكية، ويمس باستقلال القضاء وحق الدفاع، مما يستدعي الحكم بعدم دستوريته.
