تسوية المنازعات تعقد الصلح بين زوجين بعد خلافات دامت عام و8 شهور بأكتوبر
نجح مكتب تسوية المنازعات الأسرية بمحكمة الأسرة في أكتوبر، في حل نزاع بين سيدة 30 عاما وزوجها البالغ من العمر 26 عاما، بعد عام و8 أشهر من الخلافات الأسرية هجرت الزوجة منزلها مع رضيعتها، وتقدم الزوجان بـ 6 بلاغات متبادلة بينهما، ورفعت الزوجة دعوي حبس تتهم فيها زوجها بالتخلي عن مسئولية طفلته ودعوى طلاق للضرر.
وذكرت الزوجة، خلال طلبها لمكتب تسوية المنازعات للطلاق للضرر، أنها تركت منزل الزوجية بسبب تنمر حماتها وأخوات زوجها عليها بسبب فارق السن بينهما، مؤكدة أنها وكان زوجها قد تخلى عنها ورفض الدفاع عنها والوقوف في وجه أسرته.
وتابعت الزوجة: “تزوجت زوجي الذي أحببته لمدة عامين قبل الزواج. ولم أتخيل أنه سيتركني فريسة لأهله، مما دفعني إلى ترك بيت الزوجية مع طفلتي الرضيعة، احتجاجاً على سوء معاملة عائلتي لي، ما سبب لها ضرراً مادياً ومعنوياً جسيماً”.
ومن جانبها وافقت الزوجة على التصالح بعد أن وفر الزوج مسكن زوجية منفصلاً عن أسرته، ودفع النفقات المجمدة لطفلتها، ووقع الزوج معها اتفاقاً وتعهد بحسن معاملتها. ومن جانبها تنازلت الزوجة عن دعوى الحبس المقامة ضده بالتصالح.
أنشئت مكاتب تسوية المنازعات وفقاً للمادة 5 من القانون رقم 1 لسنة 2004 التي نصت على ما يلي: “ينشأ في دائرة اختصاص كل محكمة جزئية مكتب أو أكثر لتسوية المنازعات الأسرية يتبع وزارة العدل ويضم مكتباً لتسوية المنازعات”. عدد من المتخصصين (القانونيين والاجتماعيين والنفسيين) الذين يصدر بقواعد اختيارهم قرار من الوزير. “العدل” بهدف إزالة أسباب الشقاق والخلاف بين أفراد الأسرة ومحاولة التوفيق في دعاوى الأحوال الشخصية التي يمكن التوفيق بينها قانوناً. ويتم تدريب موظفي المكتب بشكل دوري على كيفية التعامل مع الأزواج والحالات التي يواجهونها من أجل محاولة إنهاء الخلافات بما يحفظ كيان الأسرة، وتوضيح النتائج والآثار المترتبة على الاستمرار في الخلافات وتقديم النصح والإرشادات لتسوية الخلاف ودياً.
