القانون يخصص معظم المبالغ المحصلة بمخالفات البناء لمشروعات البنية التحتية
وافق على مشروع قانون التصالح في بعض مخالفات البناء، بعد أن أقره مجلس النواب نهائياً، والذي يأتي لتسهيل تقدم المواطنين وتحفيزهم للتقدم للتصالح في المخالفات القائمة، مع إعطاء الأولوية للمبالغ المحصلة للخزانة العامة للدولة. وأغلبها لصالح صندوق الإسكان الاجتماعي ودعم التمويل العقاري ومشاريع البنية التحتية بالإضافة إلى نسبة لمكافأته. اللجان العاملة المسؤولة عن تطبيق القانون.
وفي هذا الصدد نصت المادة (11) على أن تحول نسبة (3%) من المبالغ المحصلة وفقاً لأحكام هذا القانون إلى الجهة الإدارية المختصة، كل فيما يخصه، لمكافأة المستحقين. أعضاء اللجان المنصوص عليها في هذا القانون، وغيرهم من العاملين في الجهة الإدارية المختصة والوحدات المحلية. وتصدر الجهات والهيئات والسلطة المختصة قرارا بتحديد النسبة المقررة مما تستحقه كل فئة من الفئات المذكورة.
وبحسب المادة القانونية، يؤول باقي الحصيلة إلى الخزانة العامة للدولة، على أن تخصص النسب التالية لصالح الجهات:
أ- نسبة قدرها (25%) لصالح صندوق دعم الإسكان الاجتماعي والتمويل العقاري.
(ب) نسبة (39%) لصالح الجهة الإدارية التي تقع في دائرتها الجهة المخالفة وموضوع التصالح لمشاريع البنية التحتية مثل الصرف الصحي ومياه الشرب وغيرها من المشاريع التنموية، وذلك بناءً على قرار من رئيس مجلس الوزراء، بناء على عرض من الوزير المسؤول عن التخطيط والتنمية الاقتصادية.
