كبسولة × القانون.. أشخاص لهم الحق في حضور تنفيذ عقوبة الإعدام
وبعد صدور حكم الإعدام واجب النفاذ على المتهم، يتم إيداعه السجن بناء على الأمر الصادر من النيابة العامة. أثناء تنفيذ عقوبة الإعدام، هناك بعض الأشخاص الذين يحق لهم حضور تنفيذ الحكم.
ونصت المادة 474 من قانون الإجراءات: يجب أن يكون تنفيذ عقوبة الإعدام بحضور أحد أعوان النيابة العامة، أو مأمور السجن، أو طبيب السجن، أو طبيب آخر تندبه النيابة العامة. ولا يجوز لغير المذكورين أن يحضروا التنفيذ إلا بإذن خاص من النيابة العامة، ويجب أن يكون المدافع مفوضاً دائماً. لكي يحضر المحكوم عليه.
ونصت في فقرتها الثانية: أنه يجب قراءة نص حكم الإعدام والتهمة التي حكم على المحكوم عليه بها في مكان التنفيذ على مسمع من الحاضرين. إذا رغب المحكوم عليه في الإدلاء بأقوال، فيحرر وكيل النيابة العامة محضراً بذلك.
