وقد عرف قانون العقوبات معنى العمد مع سبق الإصرار، كما حدد عقوبة القتل العمد مع سبق الإصرار والترصد، والقتل بدونهما.
ونصت المادة 230 على أن من قتل نفساً عمداً مع سبق الإصرار أو العمد، يعاقب بالإعدام. كما نصت المادة 231 على أن العمد المسبق هو القصد المحدد قبل الفعل لارتكاب جنحة أو جناية يكون غرضها الإضرار بشخص معين أو غير معين. وجده أو صادفه، سواء كان ذلك النية متوقفا على حدوث أمر، أو مشروطا بشرط.
ونصت المادة 232 على أن المتربص هو من يتربص لشخص في مكان واحد أو أكثر لمدة من الزمن، طويلة أو قصيرة، بقصد قتل ذلك الشخص أو إيذائه بالضرب أو نحوه.
كما نصت المادة 233 على أن من قتل شخصاً عمداً بجواهر تؤدي إلى الموت عاجلاً أو آجلاً، يعتبر قاتلاً بالسم، مهما كانت طريقة استعمال تلك الجواهر، ويعاقب بالإعدام. ونصت المادة 234 على أنه يعاقب بالسجن المؤبد أو المشدد من قتل نفساً عمداً دون عمد أو رقابة..
ومع ذلك يحكم على مرتكب هذه الجناية بالإعدام إذا سبقت جناية أخرى أو صاحبتها أو تلتها. أما إذا كان القصد التمهيد لارتكاب جنحة أو تسهيلها أو ارتكابها فعلاً أو مساعدة مرتكبيها أو شركائهم على الهروب أو الإفلات من العقوبة، فتكون العقوبة الإعدام أو السجن المؤبد. وتكون العقوبة الإعدام إذا ارتكبت الجريمة لغرض إرهابي.
وتوضح المادة 235 أن المتورطين في جريمة قتل تستوجب الحكم على مرتكبها بالإعدام يعاقبون بالإعدام أو السجن المؤبد. كما نصت المادة 236 على أن من جرح أو ضرب شخصاً عمداً أو أعطاه مواد ضارة دون قصد القتل، وأدى ذلك إلى الوفاة، يعاقب بالسجن المشدد أو السجن. من ثلاث إلى سبع سنوات. فإذا سبق ذلك قصد أو إصرار كانت العقوبة السجن المشدد أو السجن.
وتكون العقوبة السجن المشدد أو السجن إذا ارتكبت الجريمة تنفيذا لغرض إرهابي. وإذا سبق القصد أو العمد كانت العقوبة السجن المؤبد أو السجن المشدد.
