يحظر القانون رقم 208 لسنة 2020 بإصدار قانون تنظيم الإعلانات على الطرق العامة وضع إعلان أو لافتة دون الحصول على ترخيص، حيث نصت المادة 3 من القانون على أنه لا يجوز وضع إعلان أو لافتة إلا بعد الحصول على ترخيص بذلك وذلك من الجهة المختصة .
يتم إصدار الترخيص بناءً على طلب المعلن، ويجب على الجهة المختصة أن تبت في الطلب خلال ستين يوماً من تاريخ تقديمه. ويعتبر مرور المدة المذكورة دون صدور قرار بمثابة موافقة ضمنية على أن يستكمل الطلب المستندات المطلوبة بعد إخطار الجهة المختصة وفقا للضوابط التي تحددها اللائحة التنفيذية لهذا القانون.
ويصدر الترخيص لمدة لا تزيد على ثلاث سنوات بعد مراعاة متطلبات التنظيم والتخطيط ومظهر المنطقة ومراعاة الحركة المرورية فيها.
ويجوز تجديد مدة الترخيص لمدة مماثلة أو أكثر بناءً على طلب المرخص له وموافقة السلطة المختصة.
ويجوز للسلطة المختصة أن تصدر قراراً بإلغاء الترخيص وفقاً لمتطلبات تنظيمية أو تخطيطية جديدة أو اعتبارات تتعلق بمظهر المنطقة أو تنظيم المرور فيها، وذلك دون الإخلال بحق المرخص له في الحصول على التعويض إذا لزم الأمر.
فيما نصت المادة الرابعة على أنه لا يجوز الترخيص بوضع أي إعلانات أو لافتات تخالف المبادئ والمعايير التي تحددها الهيئة.
وفقا للمادة 5 من القانون، يصدر رئيس السلطة المختصة قرارا بتحديد الرسوم المستحقة على إصدار أو تجديد ترخيص الإعلان أو اللافتات، وفقا للضوابط التي تحددها الهيئة بما لا يتجاوز عشرة آلاف جنيه، أن يتم سدادها نقداً أو بأي وسيلة من وسائل الدفع الإلكتروني إلى السلطة المختصة.
تتولى كل جهة تحديد رسم استغلال الأماكن التي توضع فيها الإعلانات، وتذهب نسبة (20%) من هذا الرسم إلى الخزانة العامة للدولة.
ومع عدم الإخلال بالضرائب المستحقة للدولة ومع مراعاة حرمة الطرق حسب تصنيفها، لا يسري حكم الفقرة الثانية من هذه المادة على الإعلانات أو اللافتات التي توضع على المباني والأراضي المملوكة للقطاع الخاص الطبيعي أو الخاص. الأشخاص الاعتباريين تجاه مستخدمي الطريق.
