تجديد حبس متهمين بسرقة مواطن بالإكراه فى مدينة الشروق 15 يوما
قرر قاضي المعارضات بمحكمة جنح الشروق وبدر، تجديد حبس المتهمين بالسطو القسري على مواطن بمدينة الشروق، 15 يومًا على ذمة التحقيقات.
وكشفت التحقيقات أن المتهمين أوقفوا شاباً يستقل دراجة نارية، واعتدوا عليه بالضرب بالسكين وعصا خشبية، كما استولوا على دراجته النارية ومتعلقاته.
واعترف المتهم بارتكاب الواقعة، وتم اتخاذ الإجراءات القانونية.
وتعاقب المادة 318 من قانون العقوبات كل من يرتكب سرقة مدة لا تزيد على سنتين على السرقات التي لا يصاحبها ظرف مشدد..
السرقات التي تتوفر فيها إحدى الظروف المشددة المنصوص عليها في المادة 317، يعاقب عليها بالسجن مع الأشغال الشاقة لمدة ثلاث سنوات. وفي حالة العودة يجوز تشديد العقوبة بوضع المتهم تحت مراقبة الشرطة لمدة لا تقل عن سنة أو سنتين على الأكثر. وهذه عقوبة تكميلية منصوص عليها في المادة 320 من قانون العقوبات..
وتكون عقوبة السجن في جرائم السرقة أو الشروع فيها نافذة فوراً ولو تم استئنافها.
