أقامت زوجة دعوى حبس ضد زوجها لاحتجازه مصاريف مراتب وأغطية بقيمة 117 ألف جنيه، واتهمته بالتخلي عنها وعن أطفالها لمدة 3 سنوات ورفض سداد حقوقهم القانونية. وأكدت: “لقد دمر حياتي وشوه سمعتي وفضحني بين أهلي وأصدقائي”.
وتابعت الزوجة دعواها أمام محكمة الأسرة بالجيزة: “دمر حياتي ولحقني واعتدي علي أكثر من مرة في الشارع وأنا رايحة الشغل، علشان أعيش أنا وأولادي في جهنم بسببه”. السلوك والعصبية المفرطة.”
ورد الزوج برفع دعوى تشهير على زوجته، واتهمها بمخالفته، وملاحقته بدعوى اتهامات كيدية، آخرها دعوى الفراش والغطاء، علما أنها تتقاضى أكثر من 15 ألف جنيه مصروفات عن كل شهر. شهر.
وأكد الزوج ادعاءه أمام محكمة الأسرة: “زوجتي تخلت عني ورفضت كل الحلول الودية وأشعلت الخلافات بيننا. بلاغات وعشرات الدعاوى رفعت ضدي في محكمة الأسرة للحصول على الطلاق بسبب الضرر رغم أن الاعتداء كان من جانبها بحسب التقارير الطبية وشهادة الشهود والمستندات، بعد أن دمرتني ودمرت زواجنا. لقد برعت في الإساءة إليّ، حتى أعيش في العذاب بسببها”.
يشار إلى أن المادة رقم 76 مكرر في القانون رقم 1 لسنة 2000 نصت في فقرتها الأولى على أنه إذا امتنع المحكوم عليه عن تنفيذ الحكم النهائي الصادر في دعاوى المصاريف والأجور ونحوها جاز للمحكوم عليه بإحالة الأمر إلى المحكمة التي أصدرت الحكم الذي يجري التنفيذ في دائرتها. فإذا ثبت أن المحكوم عليه قادر على تنفيذ ما حكم عليه به، وأمرته بتنفيذه ولم يمتثل، حكمت المحكمة بحبسه مدة لا تزيد على ثلاثين يوماً.
