الحبس والغرامة عقوبة إنشاء أو تشغيل شبكات الاتصالات بدون ترخيص
نص قانون تنظيم الاتصالات على أنه يرتكب، دون الحصول على ترخيص من الجهاز القومي لتنظيم الاتصالات، وفقاً لأحكام هذا القانون، أياً مما يلي: الأفعال الآتية:
1- إنشاء أو تشغيل شبكات الاتصالات.
2- إنشاء البنية التحتية لشبكات الاتصالات.
3- تقديم خدمات الاتصالات.
4- تحويل المكالمات الهاتفية الدولية بأي وسيلة.
وتصادر جميع المعدات والأجهزة والوصلات المستخدمة في ارتكاب هذه الجريمة، وتحكم المحكمة من تلقاء نفسها بإلزام المحكوم عليه بالتعويض المناسب في الحالة المنصوص عليها في البند (4) من هذه المادة.
جدير بالذكر أن المادة 21 نصت على أنه لا يجوز إنشاء أو تشغيل شبكات اتصالات أو تقديم خدمات اتصالات للغير أو إجراء مكالمات هاتفية دولية أو الإعلان عن أي شيء من هذا القبيل إلا بعد الحصول على ترخيص من الجهاز القومي لتنظيم الاتصالات وفقا لأحكام هذا القانون. هذا القانون والقرارات المنفذة له. ولكن ليس من الضروري الحصول على ترخيص من الجهاز القومي لتنظيم الاتصالات لإنشاء أو تشغيل شبكة اتصالات خاصة لا تستخدم أنظمة الاتصالات اللاسلكية. ويلتزم المشغل المرخص له بإخطار الجهاز القومي لتنظيم الاتصالات بالشبكات الخاصة المقامة على بنيته التحتية.
