ضوابط حصول الموظف على العلاوة التشجيعية.. النص فى القانون
يمنح قانون الخدمة المدنية الصادر رقم 81 لسنة 2016 حوافز للموظفين والعاملين بالجهاز الإداري للدولة. نصت المادة (38) من قانون الخدمة المدنية على أنه يجوز للسلطة المختصة منح الموظف مكافأة تشجيعية مقدارها 5% من أجره الوظيفي، وفقاً للشروط التالية:
1- أن تكون كفاءة الموظف محددة على الأقل خلال السنتين الأخيرتين.
2- لا يجوز منح الموظف هذه المكافأة أكثر من مرة واحدة كل ثلاث سنوات.
3- ألا يزيد عدد الموظفين الذين يمنحون هذه المكافأة في السنة الواحدة عن 10% من عدد العاملين في الوظائف في كل مستوى من كل مجموعة نوعية على حدة. وإذا قل عدد العاملين في تلك الوظائف عن عشرة، صرفت المكافأة لواحد منهم.
ومن الجدير بالذكر أن قانون الخدمة المدنية يتضمن أيضاً العديد من الحوافز للموظفين والعاملين في الجهاز الإداري للدولة الخاضعين لأحكامه، منها حافز التفوق العلمي الذي يمنح للموظف الحاصل على مؤهل أعلى أثناء الخدمة، ونسبة ويحدد هذا الحافز من الأجر الوظيفي وفئاته، كما نصت المادة (39) يمنح الموظف الذي حصل على مؤهل أعلى أثناء الخدمة حافز التفوق الأكاديمي. ويمنح الموظف هذا الحافز إذا حصل على درجة الماجستير أو ما يعادلها أو شهادتين دراسات عليا مدة كل منهما سنة دراسية على الأقل.
