القضاء يتصدى لافتراء الزوجات على أزواجهن بالإستناد لـ"شهادة التسامع".. برلمانى
رصد الموقع البرلماني المتخصص بالشأن التشريعي والبرلماني، في تقريره تحت عنوان: “القضاء يواجه افتراء الزوجات على أزواجهن”، استعرض خلاله حكم قضائي برفض دعوى الطلاق للضرر بسبب عدم لوجود أدلة يقينية على الضرر، وأرسلت أقوال الزوجة، ولا تجوز الشهادة بالسمع، بل برؤية الشهادة. عين.
ويتناول الحكم افتراء الزوجات على أزواجهن بالاعتداء عليهن، ومن ثم يجوز رفع دعوى الطلاق عليهن للضرر، مما يترتب عليه حصولهن على حقوقهن كاملة، في القضية المسجلة تحت رقم 2337 لسنة 2022، عائلة متنوعة.
أما في مسألة شهادة الشهود، فاستندت «المحكمة» إلى حكم محكمة التمييز المقيدة برقم 76 لسنة 65 قضائية، والذي جاء فيه: ثبت بحكم التمييز أن: «ما هو والمقرر في حكم هذه المحكمة أن مبدأ الشهادة هو أن الشاهد يجب أن يتفقد موضوع الشهادة بنفسه. ولا يجوز له أن يشهد على شيء لم يره بعينه ولا سمعه، إلا في الأحوال التي تصح فيها الشهادة مع التسامح، ولا يشمل ذلك إثبات أو نفي الأسباب الشرعية التي تعتمد عليها الزوجة في امتناعها عن الشهادة. وتطيع زوجها، فإن البيئة تحتوي على شهادة أصلية من رجلين عدلين أو من رجل وامرأتين. تعديل مع مراعاة الفقه الحنفي الأصح الذي يجب الرجوع إليه وفقا لنص المادة 280 من نظام المحاكم الشرعية المعمول به في الدعوى، وإليكم التفاصيل كاملة:
