ويوضح قانون العقوبات المصري الحالات التي لا يجوز فيها توقيع أي عقوبة على مرتكب الجريمة، حيث نصت المادة 61 على أنه لا عقوبة على من ارتكب جريمة أكره على ارتكابها لضرورة حماية نفسه أو غيره من الجريمة. خطر جسيم على النفس يوشك أن يحدث له أو لغيره، ولا تأثير لإرادته. ولا يستطيع أن يفعل ذلك، ولا يستطيع أن يمنعه بأي طريقة أخرى.
كما نصت المادة 62 على أن الشخص الذي يعاني وقت ارتكاب الجريمة من اضطراب نفسي أو عقلي يفقده الوعي أو الاختيار، أو يعاني من غيبوبة ناتجة عن تناول المواد المخدرة أيا كان نوعها، لا يعد جنائيا. ويكون مسئولاً إذا أخذها عنوة أو دون علمه بها..
ويظل مسؤولاً جنائياً من يعاني وقت ارتكاب الجريمة من اضطراب نفسي أو عقلي أدى إلى ضعف وعيه أو اختياره. وعلى المحكمة أن تراعي هذا الظرف عند تحديد مدة العقوبة..
