5 ضوابط تنظم إعارة موظفى الجهاز الإدارى للعمل بالداخل أو الخارج
يضع قانون الخدمة المدنية رقم (81) لسنة 2016 الضوابط التي تنظم إعارة الموظفين بالجهاز الإداري للدولة للعمل في الداخل والخارج. وفي هذا السياق نص قانون الخدمة المدنية في المادة (35) على ما يلي:
1 – يجوز بقرار من السلطة المختصة ندب الموظف للعمل داخل الدولة أو خارجها بعد موافقته الكتابية، ويحدد القرار الصادر بالإعارة مدتها.
2- يترتب على ندب شاغل الوظيفة الإدارية القيادية أو الإشرافية انتهاء مدة خدمته.
3- تتحمل الجهة المقترضة كامل مكافأة الموظف المعار، وتدخل مدة الإعارة ضمن مدة خدمته.
4- لا يجوز ترقية المعار إلا بعد عودته من الإعارة واستكمال المدة الانتقالية اللازمة لشغل الوظيفة الأعلى مباشرة. – ألا تدخل مدة الإعارة ضمن المدة الانتقالية اللازمة للترقية.
5 – تدخل فترة الإعارة ضمن مدة اشتراك الموظف في نظام التأمينات الاجتماعية واستحقاقه للمكافأة مع مراعاة أحكام قانون التأمين الاجتماعي الصادر بالقانون رقم 79 لسنة 1975.
ومن الجدير بالذكر أن المادة 71 من قانون الخدمة المدنية نصت على أنه يستحق الموظف عند انتهاء خدمته تعويضاً عن رصيد إجازاته الاعتيادية التي اكتسبها قبل نفاذ أحكام هذا القانون والتي كان يستحقها. ولم يستنفد قبل نهاية خدمته. ويحسب التعويض النقدي على أساس الأجر الأساسي بالإضافة إلى العلاوات الخاصة التي كان يتقاضاها حتى تاريخ العمل بهذا القانون.
