سبب مثول الفنانة نسرين طافش أمام المحكمة بعد حكم حبسها 3 سنوات فى"شيك بدون رصيد"
عقب صدور حكم غيابي من محكمة جنح الشيخ زايد ضد الفنانة نسرين طافش بالحبس ثلاث سنوات مع الشغل وكفالة عشرين ألف جنيه مع وقف تنفيذ الحكم مؤقتا بسبب شيك سيء، قالت الفنانة نسرين ومن المقرر أن يمثل طافش يوم الاثنين المقبل أمام محكمة جنوب الجيزة الابتدائية الدائرة 16 جنح جزئية أكتوبر المقبل. كتابة خطاب أمام المحكمة تمهيداً لإرسال الكتاب إلى خبراء التزوير والتزييف بمصلحة الطب الشرعي لإعداد تقرير حول صحة التوقيع أم لا.
وفي 30 يناير 2023، كلفت النيابة العامة نسرين طافش بدائرة منطقة الشيخ زايد، بإصدار شيك بسوء نية لصالح المجني عليها نشوى صفاء الدين بمبلغ 4 ملايين جنيه. وأحيلت القضية التي حملت رقم 1636 لسنة 2023 إلى المحاكمة.
وتنتهي وقائع القضية على ما ثبت في يقين المحكمة – بينما ما ثبت في الأوراق ومحاضر جمع الاستدلالات أيدت الجنحة من تقرير المجني عليه بأن المتهم أصدر شيكاً مصرفياً بتاريخ 30 يناير الماضي لصالح للمجني عليه بالمبلغ المشار إليه وتبين عدم وجود رصيد مقابل متاح وقابل للسحب بعلم المتهم. مع ذلك.
ودعما لدعواه، قدم دفاع المجني عليه نسخة ممسوحة ضوئيا من الشيكات المصرفية بنفس التاريخ، متضمنة أمرا من المتهم إلى البنك بدفع المبلغ للمجني عليه، مع توقيع المتهم، فضلا عن نسخة ممسوحة ضوئيا رفض البنك الشيك لعدم كفاية الرصيد.
وقضت المحكمة غيابيا، في جلسة 26 يونيو 2023، بحبس المتهم ثلاث سنوات مع الشغل وكفالة عشرين ألف جنيه مع وقف تنفيذ الحكم مؤقتا.
