يحدد قانون الخدمة المدنية رقم (81) لسنة 2016 عدد ساعات العمل أسبوعيا للموظفين في الجهاز الإداري للدولة، والحد الأدنى والأقصى لساعات العمل.
ونصت المادة (45) من قانون الخدمة المدنية على أن الجهة المختصة تحدد أيام العمل في الأسبوع وتوقيتها وتوزيع ساعاتها بما يتوافق مع مقتضيات المصلحة العامة، على أن يكون عدد ساعات العمل الأسبوعية ألا تقل عن خمس وثلاثين ساعة ولا تزيد عن اثنتين وأربعين ساعة.
وبحسب المادة، يتم تخفيض عدد ساعات العمل اليومية بمقدار ساعة واحدة للموظفة ذات الإعاقة، والموظفة التي ترضع طفلها حتى بلوغه سن السنتين، وغيرها من الحالات التي تحددها اللائحة التنفيذية. لا يجوز للموظف التوقف عن العمل إلا في الإجازة المصرح له بها في حدود الإجازات المنصوص عليها في هذا القانون ووفقاً للضوابط. والإجراءات التي تحددها اللائحة التنفيذية، وإلا حرم من أجره مع عدم الإخلال بمسئوليته التأديبية.
جدير بالذكر أن قانون الخدمة المدنية نص على أنه يحق للموظف إجازة بأجر كامل في أيام العطل والمناسبات الرسمية التي يصدر بتحديدها قرار من رئيس مجلس الوزراء. ويجوز تشغيل الموظف في هذه الإجازات إذا لزم الأمر، مع منحه أجراً مضاعفاً أو إجازة بدلاً منه، وينطبق ذلك على أيام العطل. وتشمل الأحكام الدينية لغير المسلمين أحكام قرار رئيس مجلس الوزراء الصادر في هذا الشأن.
