8 مخالفات عقوبتها الحبس وغرامة 10 آلاف جنيه بقانون حماية الملكية الفكرية
ويحدد قانون حماية الملكية الفكرية عقوبة الحبس مدة لا تزيد على ستة أشهر والغرامة التي لا تقل عن ألفي جنيه ولا تزيد على عشرة آلاف جنيه أو بإحدى هاتين العقوبتين، كل من ارتكب المخالفات التالية:
1 – كل من وضع بياناً تجارياً غير مطابق للحقيقة على منتجاته أو محلاته أو متاجره أو فيها أو على عناوينها أو على الأغلفة أو الفواتير أو المراسلات أو الوسائط أو أي شيء آخر يستعمل. لعرض المنتجات للجمهور.
2- كل من ذكر على علاماته التجارية أو أوراقه التجارية بغير حق بياناً يؤدي إلى الاعتقاد بتسجيلها.
3- كل من استعمل علامة غير مسجلة.
4 – كل من ذكر أوسمة أو دبلومات أو جوائز أو درجات فخرية أياً كان نوعها على منتجات لا تتعلق بها أو على أشخاص أو أسماء تجارية لم يحصل عليها.
5- كل من يشترك مع غيره في عرض المنتجات ويستخدم لمنتجاته المزايا الممنوحة للمعارض المشتركة ما لم يبين بوضوح مصدر تلك المزايا ونوعها.
6- كل من وضع مؤشرات جغرافية على السلع التي يتجر بها – في منطقة ذات شهرة خاصة في إنتاج سلعة معينة – على نحو يوهم الجمهور بأنها منشؤها هذه المنطقة.
7- كل من استعمل أية وسيلة في تسمية أو عرض سلعة توحي بطريقة توحي للجمهور بأن منشأها منطقة جغرافية ذات شهرة خاصة خلافاً لمنشأها الحقيقي.
8- يجب على كل منتج لسلعة في منطقة ذات شهرة خاصة في إنتاجها أن يضع على السلع المماثلة التي ينتجها في مناطق أخرى مؤشراً جغرافياً يوحي بأنها منتجة في المنطقة المشار إليها.
ووفقا للقانون، تكون العقوبة في حالة العود الحبس مدة لا تقل عن شهر والغرامة التي لا تقل عن أربعة آلاف جنيه ولا تزيد على عشرين ألف جنيه.
