حبس وغرامة 100 ألف جنيه عقوبة استخدام أجهزة تشفير بدون ترخيص
ويحدد قانون تنظيم الاتصالات عقوبة استخدام أجهزة التشفير في خدمات الاتصالات دون موافقة الجهات المختصة. وفي هذا الصدد، نصت المادة 64 على أن مشغلي ومقدمي خدمات الاتصالات والشركات التابعة لهم، وكذلك مستخدمي هذه الخدمات، يلتزمون بعدم استخدام أي أجهزة لتشفير خدمات الاتصالات، إلا بعد الحصول على موافقة الجهات المختصة. المعنية، ولا ينطبق ذلك على أجهزة التشفير الخاصة بالبث الإذاعي والتلفزيوني.
وتنص المادة على أنه “مع مراعاة حرمة الحياة الخاصة للمواطنين التي يحميها القانون، يلتزم كل مشغل أو مقدم خدمة بأن يقدم، على نفقته، ضمن شبكة الاتصالات المرخص له بها، كافة الخدمات التقنية”. القدرات، بما في ذلك المعدات والأنظمة والبرامج والاتصالات ضمن شبكة الاتصالات. وينص على أن تقديم الخدمة يجب أن يتزامن مع توفير الإمكانيات. يلتزم مقدمو ومشغلو خدمات الاتصالات ووكلاؤهم المكلفون بتسويق هذه الخدمات بالحصول على معلومات وبيانات دقيقة عن مستخدميهم من المواطنين ومن مختلف الجهات في الدولة.
بينما نصت المادة 81 على أنه يعاقب بالحبس والغرامة التي لا تقل عن عشرة آلاف جنيه ولا تزيد على مائة ألف جنيه كل من يخالف أي حكم من أحكام المادة (64) من هذا القانون. كما تحكم المحكمة بإيقاف الترخيص مؤقتاً لحين قيام المخالف بتوفير الأجهزة والأنظمة والبرامج. الاتصالات المشار إليها في تلك المادة.
