عقوبات للمتهربين والمتأخرين عن تقديم الإقرارات الضريبية فى القانون
يعاقب كل من تأخر في تقديم الإقرار وسداد الضريبة عن المدد المنصوص عليها في المادة (31) من هذا القانون بما لا يزيد على ستين يوماً، بغرامة لا تقل عن ثلاثة آلاف جنيه ولا تزيد على خمسين ألف جنيه، بالإضافة إلى الضريبة والمبالغ الأخرى المستحقة. قانون الإجراءات الضريبية الموحد.
كما يعاقب بذات العقوبة كل من قدم بيانات كاذبة في الإقرار إذا ظهر أن الضريبة تزيد عما تم الإقرار به، ومن لم يمكّن موظفي الهيئة من القيام بواجباتهم أو ممارسة صلاحياتهم في المراقبة والتفتيش. التفتيش أو الاطلاع أو طلب أو الاطلاع على المستندات وتضاعف العقوبة بحديها الأدنى والأقصى ثلاث مرات في حالة العود .
يعاقب على عدم تقديم الإقرار الضريبي المنصوص عليه في المادة (31) من هذا القانون لمدة تزيد على ستين يوماً من تاريخ انتهاء المواعيد المحددة لتقديمه بغرامة لا تقل عن خمسين ألف جنيه ولا تزيد على مليوني جنيه. جنيه، وفي حالة تكرار هذه الجريمة لأكثر من ستة أو ثلاثة عوائد شهرية. الإقرارات السنوية: وتكون العقوبة الغرامة المشار إليها في الفقرة السابقة والحبس مدة لا تقل عن ستة أشهر ولا تزيد على ثلاث سنوات، أو بإحدى هاتين العقوبتين.
يعاقب بغرامة لا تزيد على خمسين ألف جنيه كل من لم يلتزم بمسك الدفاتر والسجلات الورقية أو الإلكترونية خلال المدة المقررة قانوناً. يعاقب على مخالفة أحكام المادة (20) من هذا القانون بالسجن مدة لا تقل عن سنة، ولا تزيد على ثلاث سنوات والغرامة التي لا تقل عن خمسين ألفاً. جنيهاً ولا يزيد على مائتين وخمسين ألف جنيه أو بإحدى هاتين العقوبتين .
