اليوم.. نظر محاكمة 43 متهما بقضية "خلية العجوزة الإرهابية"
تنظر دائرة الإرهاب الأولى، المنعقدة اليوم بمحكمة بدر، محاكمة 43 متهمًا لاتهامهم بالانضمام إلى جماعة إرهابية في القضية المعروفة بـ”خلية العجوزة”.
وتعقد الجلسة برئاسة المستشار محمد السعيد الشربيني، وعضوية المستشارين عصام أبو العلا، غريب عزت، محمود زيدان، ومحمد نبيل.
وكانت نيابة أمن الدولة العليا، برئاسة المستشار خالد ضياء الدين، النائب العام الأول للنيابة، أمرت بإحالة 43 متهمًا متهمين بتولي وقيادة جماعة إرهابية إلى المحاكمة العاجلة، لمعاقبة المتهمين وفقًا لأحكام النظام. مواد الاتهام المنصوص عليها في قرار الإحالة.
ويحدد قانون مكافحة الإرهاب، في المادة 12، عقوبة إنشاء أو إدارة جماعة إرهابية، وعندما تصل هذه الجريمة إلى الإعدام.
وينص على: “يعاقب بالإعدام أو السجن المؤبد كل من أنشأ أو أنشأ أو نظم أو أدار جماعة إرهابية أو تولى زعامتها أو زعامتها”.
يعاقب بالسجن المشدد كل من انضم إلى جماعة إرهابية أو شارك فيها بأية صورة مع علمه بأغراضها. وتكون العقوبة السجن المشدد الذي لا تقل مدته عن عشر سنوات إذا تلقى الجاني تدريباً عسكرياً أو أمنياً أو فنياً من الجماعة الإرهابية لتحقيق أهدافها، أو كان الجاني من أفراد القوات. يعاقب بالسجن المؤبد كل من أكره شخصاً أو أرغمه على الانضمام إلى الجماعة الإرهابية أو منعه من الانفصال عنها.
