ضوابط بقانون الثروة المعدنية للرقابة على أعمال المناجم والمحاجر
تنص اللائحة التنفيذية لقانون الثروة المعدنية الصادرة بالقانون رقم 198 لسنة 2014 على أن تسري أحكامها على تراخيص استكشاف واستغلال خامات المناجم والمحاجر والمملحات الصادرة من السلطة المختصة بحسب الأحوال، بشرط أن تحول عائدات الإيجارات والإتاوات والرسوم المنصوص عليها في هذه اللائحة فيما يتعلق بالمناجم والمحاجر والملاحات إلى الخزانة العامة. الحالة العامة.
وفي هذا الصدد حددت اللائحة التنفيذية إجراءات المراقبة والتفتيش على أعمال المناجم والمحاجر والملاحات. وهذا على النحو التالي:
1 – تقوم هيئة الثروة المعدنية بمساعدة السلطة المختصة في وضع ضوابط لمراقبة هذه الأعمال ضمن نطاق السلطة المختصة، بما يحقق الرقابة على كمية الإنتاج والاستخراج، وفقاً لأسس الصناعة التعدينية الآمنة. طرق النقل ومراعاة السلامة والصحة المهنية داخل مناطق المحاجر.
2 – تحدد اللائحة الالتزامات التي يجب على المرخص له القيام بها، بما في ذلك ضرورة الاحتفاظ بدفاتر وسجلات منتظمة تدون فيها جميع البيانات المتعلقة بالعمالة والمعدات والخام المستخرج وكمياته وتحليلاته والمنقولة منه والمخزون وغيرها من البيانات المحددة. يتم تسجيلها بقرار من السلطة أو السلطة المختصة.
ومن الجدير بالذكر أن اللائحة التنفيذية لقانون الثروة المعدنية تناولت إجراءات استغلال المناجم، والخطوات التي يتخذها المرخص له للبحث والاستغلال، بالإضافة إلى جواز طلب المرخص له إيقاف رخصة الاستغلال مؤقتاً، مع تحديد المدة والأسباب والمبررات الفنية التي يستند إليها، على أن يرفق ذلك بطلب الإيقاف، كما توضح اللائحة الحقوق والالتزامات الممنوحة للمرخص له، وكذلك قيمة الإيجار السنوي لكل منهما. كيلو متر مربع من مساحة الاستغلال، ونسب الإتاوة التي يلتزم المرخص له بدفعها عن كل خام من قيمة إجمالي الإنتاج السنوي للخام الذي يستخدمه على أقساط ربع سنوية، على أن تتم التسوية النهائية في نهاية العام. السنة حسب النسب.
