5 سنوات.. شروط القانون لإنهاء علاقة العمل فى العقد محدد المدة
يضع قانون العمل رقم (12) لسنة 2003 الضوابط التي تنظم عملية إنهاء علاقة العمل بالنسبة لعقد العمل محدد المدة في المنشآت والمؤسسات الخاضعة لأحكام هذا القانون.
وفي هذا الصدد، نصت المادة 104 على أن عقد العمل محدد المدة ينتهي بانتهاء مدته. إذا أبرم العقد لمدة تزيد على خمس سنوات، جاز للعامل إنهاءه دون تعويض – عند انقضاء خمس سنوات – بعد إخطار صاحب العمل قبل ثلاثة أشهر من الإنهاء، وتطبق الأحكام. وتتناول الفقرة السابقة الحالات التي ينهي فيها العامل العقد بعد انتهاء المدة المذكورة.
وفقا للمادة (105) مع مراعاة أحكام المادة (106) من هذا القانون، إذا انتهت مدة عقد العمل محدد المدة واستمر الطرفان في تنفيذه، يعتبر ذلك تجديدا للعقد لمدة غير محددة. الفترة، وهذا لا ينطبق على عقود العمل للأجانب.
بينما نصت المادة 106 على أنه إذا انتهى عقد العمل محدد المدة بانتهاء مدته، جاز تجديده باتفاق صريح بين طرفيه لمدة أو لمدد أخرى. إذا تجاوزت مدة العقد الأصلية والمتجددة خمس سنوات، جاز للعامل إنهائه وفقاً لأحكام المادة (104) من هذا القانون. القانون.
ووفقاً للمادة 107، إذا أبرم عقد العمل لإنجاز عمل معين، فإن العقد ينتهي بإتمام هذا العمل. وإذا استغرق هذا الإنجاز مدة تزيد على خمس سنوات، فلا يجوز للعامل إنهاء العقد قبل إتمام العمل.
ونصت المادة 108 على أنه إذا انتهى عقد العمل المبرم لإنجاز عمل معين واستمر الطرفان في تنفيذ العقد بعد انتهاء العمل، اعتبر ذلك تجديدا للعقد لمدة غير محددة.
نص قانون العمل في المادة 109 على أنه إذا انتهى عقد العمل المبرم لعمل معين بانتهاءه، جاز تجديده بالاتفاق الصريح بين طرفيه على عمل أو غيره من الأعمال المماثلة. إذا زادت مدة إنجاز العمل الأصلي والعمل الذي جدد العقد من أجله على خمس سنوات فلا يجوز للعامل إنهاءه. يتم إبرام العقد قبل الانتهاء من هذه الأعمال.
