كيف تتقدم بطلبات التصالح فى مخالفات البناء؟ القانون يجيب
وحددت المادة (6) من قانون تصالح مخالفات البناء إجراءات تقديم طلبات التصالح، حيث نصت على أنه يجب تقديم طلب التصالح إلى الجهة الإدارية المختصة خلال مدة لا تتجاوز ستة أشهر من تاريخ العمل باللائحة التنفيذية لهذا القانون، وذلك بعد السداد. رسوم الفحص تدفع نقدا أو بأي وسيلة. من طرق الدفع غير النقدي المنصوص عليها في قانون تنظيم استخدام طرق الدفع غير النقدي الصادر بالقانون رقم 18 لسنة 2019 بما لا يتجاوز خمسة آلاف جنيه، والدفع مقابل جدية التصالح وتقنين الوضع بنسبة بما لا يزيد على 25% منه، وتحدد اللائحة التنفيذية لهذا القانون فئات الرسم ونسب الرسم. خطورة التصالح وشرعنة الوضع.
ويجوز بقرار من رئيس مجلس الوزراء، بعد موافقة مجلس الوزراء، تمديد المدة المشار إليها في الفقرة السابقة إلى مدد أخرى مماثلة، لا يزيد مجموعها على ثلاث سنوات.
ويجب على الجهة الإدارية المختصة أن تمنح طالب التصالح شهادة تفيد تقديمه، على النموذج الذي تحدده اللائحة التنفيذية لهذا القانون، مدوناً عليها رقمه وتاريخ قيده والمستندات المرفقة به.
ويترتب على تقديم هذه الشهادة إلى المحكمة أو الجهات المختصة، بحسب الأحوال، وقف النظر في الدعاوى المتعلقة بالمخالفة، ووقف تنفيذ الأحكام والقرارات والإجراءات الصادرة بشأن الأفعال المخالفة. موضوع هذا الطلب حتى البت فيه أو الفصل في التظلم بحسب الأحوال. ويعتبر طلب التصالح كأنه لم يحدث بعد مرور ستة أشهر على حصول طالب التصالح على الشهادة المذكورة وعدم استيفاء المستندات والإجراءات المقررة..
