طريقة تنظيم إدارة المؤسسة.. تعرف على اشتراطات تأسيس الجمعيات الأهلية
يتضمن قانون تنظيم مزاولة العمل الخاص ضوابط تأسيس الجمعيات الخاصة، على أن تكون من مؤسس واحد أو مجموعة من المؤسسين من الأشخاص الطبيعيين أو الاعتباريين، أو كليهما، ويضع المؤسسون نظاماً داخلياً.
سيتضمن النظام اسم المؤسسة، على ألا يؤدي ذلك إلى الخلط بينها وبين جمعية أخرى أو منظمة مجتمع مدني تشترك معها في النطاق الجغرافي لعملها، أو مع أي مؤسسة عامة في الدولة أو منظمة دولية والنطاق الجغرافي لعملها، ومقر مركز إدارتها في جمهورية مصر العربية، بالإضافة إلى الغرض الذي أنشئت المؤسسة من أجل تحقيقه، وبيان تفصيلي للأموال المخصصة لتحقيق أغراض المؤسسة، و وأخيراً طريقة تنظيم إدارة المؤسسة، بما في ذلك طريقة تعيين رئيس وأعضاء مجلس الأمناء وطريقة تعيين المدير، خاصة في حالة عدم حضور المؤسسين أو أي منهم لأي سبب من الأسباب.
كما يجوز إنشاء مؤسسة مجتمع مدني بموجب وثيقة رسمية أو وصية منشورة، أيهما يعتبر بمثابة النظام الداخلي للمؤسسة، على أن تتضمن البيانات المنصوص عليها في الفقرة السابقة.
جدير بالذكر أن عمل المجتمع المدني شهد طفرة كبيرة خلال الفترة الأخيرة، ويتضمن القانون العديد من التسهيلات والحوافز لإنشاء الجمعيات. ويأتي ذلك ترجمة لاهتمام الدولة بدور المجتمع المدني، خاصة خلال السنوات الأخيرة، حيث شهدت اهتماما غير مسبوق بعمل المجتمع المدني ودوره في التنمية.
