إحالة موظف للمحاكمة الجنائية لاتهامه بسرقة مبلغ من خزينة شركته بالهرم
أحالت النيابة العامة بالجيزة موظفًا إلى المحاكمة الجنائية، لاتهامه بسرقة 150 ألف جنيه من خزينة فرع الشركة التي يعمل بها بالهرم.
واعترف الموظف بارتكاب الواقعة، وقام بتسليم جزء من المبلغ المالي. كما اعترف بسرقة جهاز التسجيل الخاص بكاميرات المراقبة والتخلص منه على الطريق. تم اتخاذ الإجراءات القانونية اللازمة، وباشرت النيابة المختصة التحقيق وأمرت بحبسه نيابة عنه ومن ثم إحالته إلى المحاكمة.
وتنص المادة 318 من قانون العقوبات على عقوبة كل من يرتكب السرقة بالحبس مدة لا تزيد على سنتين، على السرقات التي لا يصاحبها ظرف مشدد، وبالحبس مع الشغل لمدة 3 سنوات على السرقات التي لا يقترن فيها ظرف مشدد. توافر أحد الظروف المشددة المنصوص عليها في المادة 31. 317. في حالة العود يجوز تشديد العقوبة بوضع المتهم تحت مراقبة الشرطة لمدة لا تقل عن سنة أو سنتين على الأكثر. وهذه عقوبة تكميلية منصوص عليها في المادة 320 من قانون العقوبات. عقوبة السجن في جرائم السرقة أو الشروع فيها تكون قابلة للتنفيذ الفوري ولو كان مستأنفاً.
