تنفيذ اشتراطات المخططات الاستراتيجية لمنع البناء العشوائى.. التفصيل
وينص قانون البناء على أن المتطلبات الواردة في المخططات الاستراتيجية العامة والتفصيلية للمدن والقرى تعتبر من شروط البناء التي يجب الالتزام بها ضمن المتطلبات المقررة قانوناً فيما يتعلق بتنظيم أعمال البناء.
ويجب على الوحدات المحلية مراقبة تنفيذ الاشتراطات الواردة بجميع المخططات والالتزام بها أمام الجهات المعنية، واتخاذ كافة القرارات والإجراءات للتأكد من تنفيذها، ووقف تنفيذ كافة الأعمال المخالفة لها. وفي جميع الأحوال لا يجوز للوحدات المحلية إصدار بيان بصلاحية الموقع للبناء وإصدار رخصة البناء دون وجود ترخيص. الخطة التفصيلية المعتمدة، مع عدم الإخلال بأحكام (المادة 15) من هذا الباب.
يجوز للمجلس الأعلى للتخطيط والتنمية العمرانية، بقرار مسبب لتحقيق غرض وطني، أن يقتصر على مدينة أو منطقة أو جزء منها، أو المبنى نفسه، على كل أو بعض متطلبات البناء الواردة في الخطة الاستراتيجية العامة. الخطة، أو إعفاءها منها أو بعضها. ويجوز للمجلس، بناءً على اقتراح المحافظ المختص، الموافقة على تغيير استخدام الأرض لمساحة أو لجزء منها أو للمبنى نفسه.
وتحدد اللائحة التنفيذية لهذا القانون الشروط والإجراءات التي يجب اتباعها في هذا الشأن، وقواعد تحديد ما يجوز استحقاقه من تعويض، أو مقابل أي تحسين يطرأ على العقارات وفقا لأحكام القانون رقم 11 لسنة 1980 بشأن تنظيم العقارات. قانون رقم 222 لسنة 1955 في شأن فرض التعويض عن تحسين العقارات التي تم تحسينها للمنفعة العامة
