أبرز المحظورات على الشركات المرخص لها بمزاولة نشاط التمويل الاستهلاكى
يحظر القانون رقم 18 لسنة 2020 بإصدار قانون تنظيم نشاط التمويل الاستهلاكي على الشركات المرخص لها بمزاولة نشاط التمويل الاستهلاكي ومقدمي التمويل الاستهلاكي قبول الودائع، كما يسمح لهم بالإعلان عن الحقوق المقررة لأي منهم على الأموال المنقولة الخاضعة لعقود التمويل .
تكون ممارسة نشاط التمويل الاستهلاكي وفقاً للأحكام الواردة في هذا القانون والشروط والضوابط والمعايير التي يصدر بها قرار من مجلس إدارة الهيئة، وإلزام الشركات ومديريها ومستشاريها ومقدمي التمويل الاستهلاكي والعاملين لديها. على أي منهم الحفاظ على السرية الكاملة لعملائه، وعدم الكشف عن أي معلومات خاصة بهم أو بمعاملاتهم للآخرين دون موافقتهم الخطية المسبقة وفي حدود هذه الموافقة، إلا في الحالات التي يكون فيها من الضروري تقديم معلومات محددة وفقًا مع ما تقتضيه القوانين المعمول بها.
وتأتي هذه الضوابط لفرض الرقابة على نشاط تمويل شراء البضائع بالتقسيط في مصر من خلال تنظيم العلاقة بين المستهلك والشركات المزودة للسلع والخدمات الاستهلاكية، حيث يلزم التشريع الشركات بالالتزام بضوابط التسويق والإعلان الصادرة من قبل الهيئة، خاصة فيما يتعلق بالإفصاح عن كيفية احتساب وتحديد سعر الإرجاع، والإخطار بذلك. وتحدد الهيئة حجم وطبيعة النشاط والمعوقات التي تعترضه، وفقاً لما تطلبه الهيئة.
