ويحدد قانون نزع ملكية العقارات للمنفعة العامة المشاريع التي تعتبر من أعمال المنفعة العامة، وتنص المادة (2) من القانون على أنها تعتبر من أعمال المنفعة العامة في تطبيق أحكام هذا القانون:
أولاً – إنشاء أو توسيع أو تعديل أو مد الطرق والشوارع والميادين أو إنشاء أحياء جديدة.
ثانيا – مشاريع المياه والصرف الصحي .
ثالثاً: مشاريع الري والصرف.
رابعا – مشاريع الطاقة .
خامساً: إنشاء أو تعديل الجسور والطرق الالتفافية السطحية (الشرائح) والأنفاق.
سادسا: مشاريع النقل والاتصالات.
سابعا- أغراض التخطيط العمراني وتحسين المرافق العامة.
ثامناً- ما يعتبر عملاً ذا نفع عام في أي قانون آخر.
ويجوز بقرار من مجلس الوزراء إضافة أعمال أخرى ذات نفع عام إلى الأعمال المذكورة. ويجوز أن يشمل نزع الملكية أيضاً، بالإضافة إلى العقارات اللازمة للمشروع الأصلي، أي عقارات أخرى ترى الجهة المسؤولة عن أعمال التخطيط أنها ضرورية لتحقيق غرض المشروع أو لبقائها على حالتها من حيث الشكل. أو المظهر. المساحة لا تلبي التحسين المطلوب.
ووفقاً للقانون، يصدر تقرير المنفعة العامة بقرار من رئيس الجمهورية أو من يفوضه، مشفوعاً بما يلي:
أ – مذكرة تفصيلية بالمشروع المطلوب تنفيذه، مبيناً فيها قيمة التعويض الأولي الذي يجب إيداعه في حساب الجهة المختصة بإجراءات نزع الملكية المشار إليها في المادة (6) من هذا القانون، وذلك خلال شهر من تاريخه. صدور قرار المنفعة العامة.
(ب) رسم المخطط العام للمشروع والعقارات اللازمة له.
