وينص قانون حقوق الأشخاص ذوي الإعاقة الصادر رقم 10 لسنة 2018 على أنه لكي يحق للشخص ذي الإعاقة الحصول على أي من الخدمات المقررة له، يجب أن تتوفر فيه شرطين مهمين، وهما الأول، أن يجب عليه أن يكون لديه بطاقة إثبات الإعاقة والخدمات المتكاملة الصادرة من الوزارة المختصة مع تحديد نوع الإعاقة ودرجتها. الشرط الثاني: أن يكون الشخص ذو الإعاقة مصري الجنسية أو أجنبياً مقيماً بشرط المعاملة بالمثل.
وفي هذا السياق يحدد القانون كيفية الحصول على بطاقة إثبات الإعاقة والخدمات المتكاملة. وحدد القانون 5 إجراءات للحصول على البطاقة وهي كالتالي:
1- يجب على طالب الحصول على بطاقة إثبات الإعاقة والخدمات المتكاملة أن يقدم تقريرًا طبيًا صادرًا من إحدى مستشفيات وزارة الصحة والجهات التابعة لها أو المستشفيات الجامعية أو المستشفيات التابعة للقوات المسلحة والشرطة موضحًا فيه الحالة الطبية. تشخيص حالته، مما يؤكد وجود إصابة أو مرض أو حالة مرتبطة بالإعاقة.
2- يقوم طالب الحصول على بطاقة إثبات الإعاقة والخدمات المتكاملة بتسجيل بياناته في مكتب التأهيل الاجتماعي التابع لمحل إقامته، والذي صدر بشأنه قرار الوزير المسؤول عن التضامن الاجتماعي بتنظيم عمل مكاتب التأهيل الاجتماعي.
3- يطبق مكتب التأهيل الاجتماعي أداة تقييم إثبات الإعاقة ونوعها ودرجتها والتي تعتمد على التقييم الوظيفي لحالة الشخص ومدى الصعوبات الوظيفية التي يواجهها عند ممارسة أنشطة الحياة اليومية.
4- يحدد مكتب التأهيل الاجتماعي درجات الإعاقة وفق المستويات الثلاثة التي حددها القانون في المادة (3) من اللائحة في حالة إثبات الإعاقة.
5- يقوم مكتب التأهيل الاجتماعي بتقديم الخدمات للشخص ذو الإعاقة بعد تعبئة استمارة الخدمات الشاملة.
