وحدد قانون تنظيم مزاولة نشاط التمويل للمؤسسات المتوسطة والصغيرة ومتناهية الصغر عقوبة كل من ارتكب مخالفة مزاولة نشاط تمويل المؤسسات الصغيرة ومتناهية الصغر دون الحصول على ترخيص.
وفي هذا الشأن نص القانون على أنه مع عدم الإخلال بأي عقوبة أشد ينص عليها أي قانون آخر، يعاقب كل من زاول نشاطاً خاضعاً لأحكام هذا القانون دون أن يكون مرخصاً له بذلك.
ويهدف القانون إلى تنظيم ممارسة تمويل المؤسسات الصغيرة والمتوسطة التي تتم خارج القطاع المصرفي (الاقتصاد غير الرسمي) ولا تخضع لتنظيم قانوني متكامل. وأغلبها تتم من خلال آليات غير رسمية، مما يؤدي إلى إهدار الكثير من الموارد الاقتصادية الوطنية.
وبموجب القانون، يضع مجلس إدارة هيئة الرقابة المالية، بعد التنسيق مع هيئة تنمية المؤسسات الصغيرة والمتوسطة ومتناهية الصغر، قواعد وضوابط ممارسة نشاط تمويل المشاريع المتوسطة والصغيرة، وقواعد وضوابط مزاولة نشاط تمويل المشروعات متناهية الصغر، أو قواعد وضوابط ممارسة كلا النشاطين، ومعايير الملاءة المالية التي تلتزم بها الشركات حسب النشاط المرخص به.
