رصد موقع “البرلماني” المتخصص بالشأن التشريعي والبرلماني، في تقرير بعنوان: “شقق للبيع.. التمييز يسمح للمشتري باحتجاز باقي الثمن عن البائع في حال عدم التزامه بالموعد” تسليم العقار”، استعرض فيه حكماً فريداً من نوعه، يهم ملايين العملاء. في سوق البيع والشراء للوحدات السكنية والعقارات يحق للمشتري أن يحتجز باقي الثمن عن البائع، والدفاع عن عدم التنفيذ ونطاق تنفيذ الشرط الصريح والفسخ في العقود الملزمة كلا الطرفين في الاستئناف المسجل برقم 3774 لسنة 82 قضائية.
وقالت المحكمة في حيثيات الحكم إن هذا الاعتراض صحيح، لأن المشرع أجاز للمشتري في المادة 457 من القانون المدني حق حبس الثمن إذا تبين له أن هناك سبب جدي للخوف. بأن المبيع سيؤخذ من يده. ويعني ذلك أن مجرد وجود هذا السبب يخول للمشتري الحق في حبس الثمن الذي لم يدفعه، ولو كان مستحقا، حتى زوال الخطر الذي يهدده، ما لم يتنازل عن هذا الحق بعد ثبوته أو أن يكون هناك شرط في العقد يمنعه من استعماله. وفيما يلي التفاصيل الكاملة:
