تهيئة مناخ الاستثمار بإتاحة مستلزمات الإنتاج.. أبرز مكاسب القانون الجديد
جاء القانون رقم 173 لسنة 2023 فيما عدا تسجيل بعض الشركات غير المملوكة للمصريين أو المملوكة لهم بنسبة تقل عن (51%) من بعض أحكام القانون رقم 121 لسنة 1982 في شأن سجل الشركات المستوردين..
ويأتي مشروع القانون لتنفيذ حزمة من التعديلات التشريعية على القوانين المتعلقة بالاستثمار، والتي تهدف إلى إزالة كافة العوائق أمام الاستثمار. وذلك لخلق مناخ ومناخ استثماري وجذب المزيد من الاستثمارات الأجنبية والعمل على إتاحة المنتجات في الأسواق المصرية.
وتتمثل فوائد مشروع القانون الذي جاء في إطار توجيهات المجلس الأعلى للاستثمار بتشكيله الجديد في:
– تحقيق الإصلاح المتكامل ومواجهة المعوقات التي تحول دون جذب المزيد من الاستثمارات الأجنبية.
معالجة الصعوبات التي تواجه المشاريع الصناعية من خلال تسهيل وتوفير مستلزمات الإنتاج.
– يساهم في تشغيل المشاريع وزيادة إنتاجيتها وإعادة تدوير عجلة الإنتاج وتحسين مناخ الاستثمار.
معالجة المشكلات التي تمثل عائقاً كبيراً أمام تدفق الاستثمارات الأجنبية، وتحقيق المساواة بين المستثمرين المصريين وغيرهم.
ونص القانون على أنه استثناء من الفقرة الأولى من البند (ثانيا/هـ) من المادة (2) من القانون رقم 121 لسنة 1982 في شأن سجل المستوردين يجوز تسجيل الشركات المساهمة وشركات التوصية البسيطة مع الأسهم أو الشركات ذات المسؤولية المحدودة أو شراكات الأشخاص التي تكون أسهمًا. أو أن تكون حصص الشركاء فيها غير مملوكة للمصريين أو مملوكة لهم بنسبة تقل عن (51%) في سجل المستوردين على ألا تزيد إجمالي مدد القيد في السجل عن عشر سنوات من تاريخ تاريخ العمل بأحكام هذا القانون، ويجوز تمديده لمدة واحدة فقط لا تزيد على عشر سنوات بقرار من مجلس الوزراء بناء على اقتراح الوزير المسؤول عن شؤون التجارة الخارجية..
