ضوابط لإجراء تعديل على المنشأة السياحية فى القانون.. التفاصيل
يحظر قانون المنشآت الفندقية والسياحية إجراء أي تعديل جوهري على المنشأة أو النشاط المرخص له إلا بموافقة الوزارة المختصة وفقا للإجراءات وبعد دفع رسم التفتيش المنصوص عليه في المادة (10) من هذا القانون. وتحدد اللائحة التنفيذية ما هي التعديلات الأساسية..
وسيتم إصدار الترخيص للمنشأة بعد سداد رسم لا يقل عن ألف جنيه ولا يزيد على مليون جنيه، على أن يكون هذا الرسم بهذه القيمة متضمنا كافة الرسوم المقررة قانونا للجهات ذات العلاقة. ويسدد هذا الرسم للوزارة المختصة على أن تقوم بتسليم المبالغ المستحقة للجهات ذات العلاقة في حدود الفئات. المنصوص عليها في القوانين والقرارات المنظمة لهذه الجهات، وتلتزم الوزارة المختصة بإخطار طالب الترخيص خلال أسبوع من تاريخ موافقتها المبدئية على الطلب أو بحكم المدة المشار إليها في المادة (9) من هذا القانون انتهت دون الاستجابة للمتطلبات العامة والخاصة للمنشأة المراد ترخيصها..
ويجب على طالب الترخيص خلال أسبوع من تاريخ إخطاره بالمتطلبات العامة والخاصة المقررة للمنشأة المراد ترخيصها أن يلتزم بدفع رسم تفتيش لا يقل عن خمسمائة جنيه ولا يزيد على مائة ألف جنيه. . تتولى الوزارة المختصة مخاطبة الجهات ذات العلاقة لمباشرة شؤونها بشأن الطلب وفقاً لما تحدده قوانينها، ويجب على هذه الجهات موافاة الوزارة المختصة بأسباب الموافقة أو الرفض، أو طلب استكماله مرة واحدة خلال مدة زمنية محددة. مدة لا تزيد على خمسة وأربعين يوماً من تاريخ وصوله وإلا اعتبر ذلك موافقة على الطلب. .
