هل يجوز تنفيذ رحلات عمرة خارج الشركات السياحية؟ .. القانون يجيب
وألزم القانون رقم 72 لسنة 2021 بإنشاء البوابة المصرية للعمرة وتنفيذ رحلات العمرة من قبل شركات السياحة، بتنفيذ رحلات العمرة من خلال شركات السياحة المرخص لها، حيث نصت المادة 5 من القانون على أنه لا يجوز القيام برحلات العمرة إلا من خلال شركات السياحة المرخص لها بمزاولة النشاط وفقا لأحكام القانون رقم 38 لسنة 1977 بتنظيم شركات السياحة حصرا.
وتصدر القواعد والإجراءات المنظمة لتنفيذ الرحلات المشار إليها في الفقرة السابقة سنويا بقرار من الوزير المختص بالتنسيق مع الغرفة المختصة.
ونصت المادة السادسة على أنه يجب على شركات السياحة دفع تأمين مؤقت لرحلات العمرة التي تنظمها، ويصدر بتحديد قيمته وقواعد احتسابه واسترداده قرار من الوزير المختص، بعد أخذ رأي الغرفة المختصة.
ويتم الحصول على التأمين المؤقت المشار إليه في الفقرة السابقة نقدا أو بإحدى الوسائل المنصوص عليها في قانون تنظيم استخدام وسائل الدفع غير النقدية الصادر بالقانون رقم 18 لسنة 2019.
تلتزم شركات الطيران أو النقل البري أو البحري، حسب الأحوال، بمطابقة البيانات الخاصة لكل حاج مع البيانات المسجلة في البوابة قبل مغادرة الحاج لمنافذ الجمهورية.
