محظورات على موظف مصلحة الضرائب.. أبرزها المشاركة فى إجراءات تخص أقاربه
يحظر قانون الإجراءات الضريبية الموحد على موظف مصلحة الضرائب القيام أو المشاركة في أي إجراءات ضريبية تتعلق بأي شخص إذا كانت هناك علاقة قرابة حتى الدرجة الرابعة بينه وبين ذلك الشخص، وكانت هناك مصلحة أو علاقات مادية بينه والشخص الذي يخصه الإجراء أو أحد أقاربه حتى الدرجة الثالثة، إذا قرر الرئيس المباشر عدم قيام الموظف بأي إجراءات ضريبية تتعلق بذلك الشخص بسبب أي حالة تعارض في المصالح.
ويهدف القانون رقم 206 لسنة 2020 بإصدار قانون الإجراءات الضريبية الموحد إلى دمج الإجراءات الضريبية المختلفة مع مختلف أنواع الضرائب، وتبسيط الإجراءات الضريبية من خلال معالجة المشاكل الناتجة عن تطبيق الإجراءات الحالية بما يتماشى مع نظام الدولة الجديد والرقمنة والميكنة.
وينص القانون صراحة على الاعتماد على وسائل الميكنة الحديثة في اتخاذ الإجراءات الضريبية بعد انتهاء مرحلة الانتقال من الإجراءات الورقية إلى الإجراءات الآلية، ودون الإخلال بالقواعد الإجرائية الثابتة التي تكررت في القوانين الضريبية المتعاقبة تحقيقا للاستقرار في القواعد الضريبية. ويهدف القانون إلى تحقيق المزيد من الفعالية لقواعد حل المنازعات. الضريبية، وحصر التوحيد الإجرائي للقواعد المطبقة على مختلف أنواع الضرائب، وتخصيص نصوص خاصة للإدارة الضريبية لتنظيم بعض أحكام هذه الإدارة باعتبارها أحد محاور النظام الضريبي الثلاثة – إلى جانب المكلف والتشريع ..
