حبس وغرامة عقوبة موظف التأمينات حال تسهيل تهرب صاحب العمل من التزاماته للهيئة
ويحدد قانون التأمينات الاجتماعية والمعاشات رقم 148 لسنة 2019 عقوبة الموظف في الهيئة القومية للتأمين الاجتماعي إذا أفشى أسرار العمل أو ساعد صاحب العمل على التهرب من التزاماته.
وفي هذا الصدد نصت المادة (169) من قانون التأمينات الاجتماعية والمعاشات على أن كل من أفشى سراً للعاملين بالهيئة يعاقب بالحبس مدة لا تقل عن ستة أشهر وبغرامة لا تقل عن عشرين ألف جنيه. وبما لا يزيد على مائة ألف جنيه أو بإحدى هاتين العقوبتين. الصناعة أو المهنة أو العمل أو غيرها من أساليب العمل، أو يمكن أو يسمح أو يساعد أو يسهل للغير، بشكل مباشر أو غير مباشر، الوصول إلى أي من هذه الأسرار التي علم بها بموجب المادة (143) من هذا القانون. القانون أو ساعد صاحب العمل على التهرب من الوفاء بالتزاماته المنصوص عليها في هذا القانون، تحكم المحكمة من تلقاء نفسها بعزله من وظيفته.
ونصت المادة (168) على أن المسؤول الفعلي عن الإدارة لدى صاحب العمل أو الموظف المختص في الجهات الحكومية أو القطاع العام أو قطاع الأعمال العام الذي لم يشارك في الهيئة لم يقم بدفع أجر أي من عماله الذين هم مع مراعاة أحكام هذا القانون، أو إذا لم يساهم عنهم لفترات أو بأجور حقيقية.
ويعاقب بذات العقوبة المسؤول الفعلي عن الإدارة لدى صاحب العمل أو الموظف المختص في الجهات الحكومية أو القطاع العام أو قطاع الأعمال العام الذي يتحمل للمؤمن له أي حصة من مصاريف التأمين غير المنصوص عليها في هذا القانون. وتحكم المحكمة من تلقاء نفسها بإلزامه برد القيمة إلى المؤمن له. مصاريف التأمين التي تحملوها، وتضاعف العقوبة في حالة العود.
