مطلق لمحكمة الأسرة: "طليقتى اقتحمت المنزل وضربت زوجتى وطفلتى وسرقت مصوغاتها"
أقام رجل مطلق دعوى إسقاط الحضانة ضد طليقته، أمام محكمة الأسرة بالقاهرة الجديدة، متهماً إياها بالدخول إلى منزله عنوة أثناء غيابه، والاعتداء على زوجته وطفلته، وسرقة المصوغات الذهبية. وقدم المستندات الدالة على ارتكابها الواقعة، مرفقة بتسجيلات كاميرات المراقبة، مؤكداً: «طليقي منذ زواجي يلاحقني بالتهديدات ويرفض التوقف.. ويسبب لي المتاعب».
وتابع والد طفلين: “طلقتها منذ 5 سنوات وتزوجت وأنجبت ابنة. خلال تلك الفترة لم أهمل حقوقي تجاه أبنائي واستمرت في دفع المصاريف الشهرية التي تجاوزت 20 ألف جنيه. وللأسف رفضت مطلقتي التوقف عن إيذائي واستمرت في الاعتداء علي ومحاولة دفعي إلى الطلاق من زوجتي الحالية”.
وأشار الأب: “زوجتي السابقة لا تصلح كأم لتربية الأطفال. لقد شوهتني وفضحتني، وكادت أن تتسبب في انفصالي عن زوجتي بسبب غيرتها، طمعاً في أموالي. لقد رفضت كل الحلول الودية لتتركني وحدي رغم انفصالنا، وخدعت شهود زور لإيذائي في محاولة للحصول على نفقات غير مدفوعة”. “إنها تستحق أن تذوق العذاب بسبب فعلتها”
وبحسب القانون، فإن صدور حكم بالعقوق يضع الزوجة في وضع مخالفة القانون وتظلم زوجها، مما يسقط حقها في نفقة العدة والتمتع بها. للزوج الحق في استرداد المهر والممتلكات التي دفعها إذا انفصلا بحكم قضائي لأنه ثبت أن الخطأ كله من الزوجة، ونصت المادة 6 من قانون الأحوال الشخصية على التزام الزوج لإعالة زوجته وتوفير المسكن لها. ومقابل طاعة الزوجة فإن امتنعت دون سبب مبرر فهي عاصية.
