3 أفعال تعرضك للحبس في قضايا الشيكات.. تعرف عليها
تعد مسائل الشيك من المسائل التي أولىها المشرع أهمية كبيرة نظرا للمعاملات الاقتصادية التي تقوم على تلك المعاملات وأن الشيك هو أداة دفع تقوم بتدفق الأموال في المعاملات. وتنظم المادة 1/834 من قانون التجارة عقوبة عدم دفع الشيك، حيث نصت على أنه “يعاقب بالحبس”. يعاقب بغرامة لا تزيد على خمسين ألف جنيه أو بإحدى هاتين العقوبتين كل من ارتكب أحد الأفعال الآتية:
1- إصدار شيك ليس له مقابل قابل للصرف
2- استرداد كامل الرصيد أو التصرف فيه بعد إصدار الشيك بحيث لا يفي الباقي بقيمة الشيك
3- إصدار الأمر للمسحوب عليه بعدم صرف الشيك في غير الأحوال المقررة قانوناً. (1) كتابة الشيك أو التوقيع عليه بسوء نية بما يحول دون صرفه.
لما قررت محكمة التمييز أن مجرد إعطاء الشيك للمستفيد يحقق معنى عرضه المتداول. إذا تبين أنه ليس له رصيد قائم يمكن سحبه، أو أن الرصيد أقل من قيمته، أو سحب مصدره بعض رصيده بحيث لا يفي الباقي بقيمة الشيك، مع العلم بذلك. هذا أو أمر. وبعدم دفع قيمته يكون المسحوب عليه قد ارتكب الجريمة المنصوص عليها في قانون العقوبات. وننتقل إلى هذا الطرح لمعالجة الحماية القانونية التي منحها المشرع بمعاقبة هذه الجريمة، باعتبار أن الشيك أداة دفع تجري مجرى المال في المعاملات، وأن الوفاء به كالدفع بالنقود، بغض النظر عما إذا كان وذلك حفاظاً على هذه الورقة وحمايتها عند قبولها. ثم يعبر عنه في التداول بالأسباب التي دفعت صاحب الشيك إلى إصداره، إذ لا أثر لها في طبيعته، وتعتبر من الأسباب التي لا أثر لها في ثبوت المسؤولية الجنائية، والتي ولم يشترط المشرع ذلك لأنهم كانوا حاضرين فيه بالذات.
وكانت محكمة جنح الشيخ زايد، في جلستها يوم 26 يونيو 2023، قضت غيابيًا بحبس الفنانة نسرين طافش ثلاث سنوات مع الشغل وكفالة عشرين ألف جنيه لوقف تنفيذ الحكم مؤقتًا بسبب إصدار شيك. بدون توازن.
