أدلى عاطلان عن العمل باعترافات تفصيلية أمام النيابة العامة بمحكمة جنوب القاهرة، تفيد بتكوين تشكيل عصابي تخصص نشاطه الإجرامي في سرقة الأبواب الحديدية للمقابر بطريقة الخلع. وأكدوا ارتكابهم 6 وقائع سرقة سابقة بنفس الطريقة، ومع إحكام الخناق عليهم، اعترفوا بمكان الأبواب المضبوطة في مستودع يقع في أحد المنازل. واحد منهم.
وقررت النيابة في وقت سابق حبس المتهم 4 أيام على ذمة التحقيقات، وطالبت النيابة بالتأكد من السجل الجنائي للمتهم، واستدعاء المجني عليهم لمواجهتهم بالمتهم لاستكمال التحقيقات.
عقوبة السرقة
وتعاقب المادة 318 من قانون العقوبات كل من يرتكب سرقة مدة لا تزيد على سنتين على السرقات التي لا يصاحبها ظرف مشدد.
السرقات التي تتوفر فيها إحدى الظروف المشددة المنصوص عليها في المادة 317، يعاقب عليها بالسجن مع الأشغال الشاقة لمدة ثلاث سنوات. وفي حالة العودة يجوز تشديد العقوبة بوضع المتهم تحت مراقبة الشرطة لمدة لا تقل عن سنة أو سنتين على الأكثر. وهذه عقوبة تكميلية منصوص عليها في المادة 320 من قانون العقوبات.
