" روح القانون ".. هل للكلمة معنى قانونى حقيقى ؟.. خبير قانونى يجيب
“روح القانون” عبارة تتكرر كثيرا، لكن لم يعرف أحد معناها الحقيقي، وهل كان لها وجود حقيقي في نصوص القانون، أم أنها بدعة وردت على لسان أحدهم وأصبحت مكرراً، وفي إطار الخدمات التي تقدمها اليوم السابع، نقدم اليوم الرأي القانوني لمعنى “روح القانون”. القانون” .
وقال المحامي أشرف ناجي: إذا أسرع شخص بالسيارة لأنه تأخر عن حفلة فإن الأمر يختلف عن حالة الشخص الذي يسرع بالسيارة لإنقاذ ابنه أو لأن زوجته حامل وعلى وشك الولادة. . وللقاضي هنا سلطة تقديرية، ولكن بشرط ألا تختلف عن القانون بحجة روح القانون. على سبيل المثال، يتمتع قاضي المقاطعة بسلطة تقديرية. ومن خلاله يستخدم روح القانون وينظر أحياناً إلى حاجة المتهم وقت السرقة. ورغم أن الدوافع لا تؤثر في التجريم، إلا أنه يجوز للقاضي أن يطبق روح القانون لسبب محدد في ضميره.
وتابع: نجد أن روح القانون تتضح في القضايا الجنائية أكثر من غيرها، تلك التي تثير ظروفها خيال القاضي، وهل هناك دوافع نفسية أو عقلية أو مرضية أو حتى ظروف خاصة أدت إلى وقوع الجريمة. الفعل الإجرامي، وهنا يظهر للقاضي عندما يطلع على النصوص القانونية. القانون وما يسمح به نصه القانوني من تخفيف العقوبة أو إيقافها.
ويتابع ناجي: هناك حالات تختفي فيها روح القانون، وهي قضايا لا تسمح نصوصها بأي خيارات ولا تسمح للقاضي بأي سلطة تقديرية، وأبرزها قضايا القضاء الإداري. يتم تطبيق النص القانوني بمنتهى الاحترافية. فمثلاً إذا صدر قرار حكومي مخالف لقانون إداري، يصدر الحكم بإلغاء القرار وما يترتب عليه من آثار. ولهذا نجد أن روح القانون تظهر بقوة في حالات وتختفي بقوة في حالات أخرى، وفي النهاية تبقى روح القانون القشة التي يبحث عنها الغريق في لحظة أمل.
