وفي هذا الصدد نصت المادة (76) على أن كل من قاد مركبة وهو تحت تأثير مخدر أو مسكر أو قادها في الاتجاه المعاكس في طريق عام داخل المدن أو خارجها، يعاقب بالسجن مدة لا تقل عن سنة. من سنة واحدة.
وبحسب المادة القانونية، إذا نشأ عن القيادة تحت تأثير المخدرات أو المسكر أو القيادة في الاتجاه المعاكس إصابة شخص أو أكثر، تكون العقوبة الحبس مدة لا تقل عن سنتين والغرامة التي لا تقل عن خمسمائة جنيه. أقل من 10 آلاف جنيه.
وذكرت المادة أنه إذا نشأ عن ذلك وفاة شخص أو أكثر أو إصابته بعجز كلي، يعاقب بالسجن مدة لا تقل عن 3 سنوات ولا تزيد على 7 سنوات وبغرامة لا تقل عن 300 ألف جنيه. 20 ألف جنيه.
ونصت المادة القانونية على أنه في جميع الأحوال تلغى رخصة القيادة، مع عدم جواز منح رخصة جديدة إلا بعد انقضاء مدة مساوية لمدة الحبس المحكوم عليه.
